Votação Da PEC Do Orçamento De Guerra É Concluída Na Câmara.

O plenário da Câmara dos Deputados concluiu nesta quarta-feira (6), a análise da Proposta de Emenda à Constituição (PEC) 10/2020, chamada PEC do Orçamento de Guerra. A matéria segue para promulgação do presidente do Congresso Nacional, senador Davi Alcolumbre (DEM-AP).

O texto, que retornou do Senado com alterações, foi aprovado em primeiro turno pelos deputados na segunda-feira (4) . Na tarde de hoje, a proposta obteve 477 votos favoráveis e um contrário. Era necessário, no mínimo, 308 votos para que o texto fosse aprovado. Nenhuma proposta de modificação ao texto foi acatada pelos parlamentares, apenas dois trechos foram retirados da proposta. Caso houvesse modificação, a PEC deveria retornar para análise dos senadores.

Trechos retirados

O dispositivo que condicionava o recebimento de benefícios creditícios, financeiros e tributários, direta ou indiretamente, ao compromisso das empresas de manutenção de empregos foi retirado do texto da PEC pelo relator, deputado Hugo Motta (Republicanos -PB).

Outra medida retirada foi o trecho que estabelecia a lista de títulos privados que o Banco Central poderá comprar segundo autorização dada pela PEC. Dessa forma, a aquisição dos títulos ficará a critério do próprio Banco Central.

Orçamento de Guerra

Chamada de orçamento de guerra por estar relacionada exclusivamente ao enfrentamento da situação de calamidade pública, a PEC autoriza a União a descumprir a chamada “regra de ouro”. O mecanismo constitucional impede o governo de se endividar para pagar despesas correntes, como salários e custeio. A medida vale enquanto durar o estado de calamidade reconhecido pelo Congresso Nacional, previsto para terminar no dia 31 de dezembro de 2020.

Durante este período, o governo federal poderá adotar processos simplificados de contratação de pessoal, em caráter temporário e emergencial, e de obras, serviços e compras, limitando a dispensa de licitação aos gastos envolvendo o combate ao novo coronavírus, desde que não impliquem despesa permanente.

Com isso, os atos do governo e as proposições legislativas “ficam dispensados da observância das limitações legais quanto à criação, à expansão ou ao aperfeiçoamento de ação governamental que acarrete aumento de despesa e à concessão ou à ampliação de incentivo ou benefício de natureza tributária da qual decorra renúncia de receita”, diz o texto.

Para efeitos de acompanhamento dos gastos, o Ministério da Economia publicará, a cada 30 dias um relatório com os valores e o custo das operações de crédito realizadas no período de vigência do estado de calamidade pública.

A PEC autoriza o Banco Central a comprar e vender título de empresas privadas no chamado mercado secundário (nacional e internacional). A medida também permite a comercialização de ações privadas de empresas. Segundo os congressistas, os trechos visam garantir liquidez ao mercado de capitais.
