Atividades Essenciais: Lista De Serviços E Atividades É Ampliada

O presidente da República, Jair Bolsonaro, decretou a ampliação da lista de serviços e atividades considerados essenciais em meio à pandemia do coronavírus. A mudança foi publicada no Diário Oficial da União desta quarta-feira, 29, e já está em vigor.

Ao serem classificados como essenciais, as atividades e serviços podem continuar em operação mesmo durante restrição ou quarentena em razão do vírus.

Atividades essenciais

Passam a ser consideradas atividades essenciais, segundo o decreto:

– serviços de comercialização, reparo e manutenção de partes e peças novas e usadas e de pneumáticos novos e remoldados;
– serviços de radiodifusão de sons e imagens;
– atividades de desenvolvimento de produtos e serviços, incluídas aquelas realizadas por meio de start-ups;
– atividades de comércio de bens e serviços, incluídas aquelas de alimentação, repouso, limpeza, higiene, comercialização, manutenção e assistência técnica – automotivas, de conveniência e congêneres, destinadas a assegurar o transporte e as atividades logísticas de todos os tipos de carga e de pessoas em rodovias e estradas;
– atividades de processamento do benefício do seguro-desemprego e de outros benefícios relacionados, por meio de atendimento presencial ou eletrônico, – – obedecidas as determinações do Ministério da Saúde e dos órgãos responsáveis pela segurança e pela saúde do trabalho;
– atividade de locação de veículos;
– atividades de produção, distribuição, comercialização, manutenção, reposição, assistência técnica, monitoramento e inspeção de equipamentos de – infraestrutura, instalações, máquinas e equipamentos em geral, incluídos elevadores, escadas rolantes e equipamentos de refrigeração e climatização;
– atividades de produção, exportação, importação e transporte de insumos e produtos químicos, petroquímicos e plásticos em geral;
– atividades cujo processo produtivo não possa ser interrompido sob pena de dano irreparável das instalações e dos equipamentos, tais como o processo siderúrgico e as cadeias de produção do alumínio, da cerâmica e do vidro;
– atividades de lavra, beneficiamento, produção, comercialização, escoamento e suprimento de bens minerais;
– atividades de atendimento ao público em agências bancárias, cooperativas de crédito ou estabelecimentos congêneres, referentes aos programas governamentais ou privados destinados a mitigar as consequências econômicas da emergência de saúde pública;
produção, transporte e distribuição de gás natural;
– indústrias químicas e petroquímicas de matérias-primas ou produtos de saúde, higiene, alimentos e bebidas;
obras de engenharia e o fornecimento de suprimentos para o funcionamento e a manutenção das centrais geradoras e dos sistemas de transmissão e distribuição de energia.

Segundo o decreto, o rol de atividades essenciais acrescido pelo texto foi objeto de discussão e avaliação multidisciplinar por colegiado composto por representantes das áreas da vigilância sanitária, da saúde, do abastecimento de produtos alimentícios e de logística.

Decretos estaduais e municipais

No decreto, Bolsonaro fixa que o texto não afasta a competência ou a tomada de providências normativas e administrativas pelos Estados, pelo Distrito Federal ou pelos Municípios, no âmbito de suas competências e de seus respectivos territórios.

O decreto já leva em consideração decisão do Supremo Tribunal Federal, do dia 15 de abril, segundo a qual estados e municípios têm o poder de estabelecer políticas de saúde, inclusive questões de quarentena e a classificação dos serviços essenciais.

O texto publicado nesta quarta-feira altera o decreto editado por Bolsonaro em 20 de março e que trouxe a primeira definição dos serviços e atividades considerados essenciais. Desde então, essa lista vem aumentando e, pela norma em vigor, já conta com mais de 50 itens.
