Feriadão: Prefeito De SP Sanciona Antecipação De Feriados

O prefeito de São Paulo sancionou nesta terça-feira, 18, em sessão extraordinária virtual, projeto de lei que antecipa feriados municipais como forma de aumentar o isolamento social e conter a COVID-19.

O objetivo é antecipar os dois últimos feriados municipais de 2020 – Corpus Christi e Consciência Negra – e o feriado estadual de 9 de julho.

Conforme já foi anunciado pelo prefeito e pelo governador João Dória, os feriados devem começar a valer a partir desta quarta-feira, 20, e irá até segunda-feira, 25. Confira:

Feriado Nova data
Corpus Christi Quarta-feira, 20/05
Consciência Negra Quinta-feira, 21/05
9 de julho Segunda-feira, 25/05

A ideia é que a sexta-feira, 22/05, seja ponto facultativo para as empresas. Vale lembrar que a MP 927/2020 já permitia antecipações em casos de calamidade pública.

MP 927

Segundo o Artigo 13 da MP 927, “durante o estado de calamidade pública, os empregadores poderão antecipar o gozo de feriados não religiosos federais, estaduais, distritais e municipais e deverão notificar, por escrito ou por meio eletrônico, o conjunto de empregados beneficiados com antecedência de, no mínimo, quarenta e oito horas, mediante indicação expressa dos feriados aproveitados. § 1º Os feriados a que se refere o caput poderão ser utilizados para compensação do saldo em banco de horas. § 2º O aproveitamento de feriados religiosos dependerá de concordância do empregado, mediante manifestação em acordo individual escrito.”

Contudo, com a MP 927, os funcionários tinham a opção de concordar ou não com a antecipação. Porém, tudo indica que com a aprovação e publicação do decreto da Prefeitura e Governo do Estado de São Paulo, o funcionário perde o direito de escolha por ser obrigatório para todas as atividades e empresas.

Urgência

De autoria do poder executivo, o texto sancionado também trata do estímulo à contratação de mulheres integrantes do programa Tem Saída, voltado para mulheres em situação de violência doméstica.

O PL prevê que nas contratações firmadas pela prefeitura para a prestação de serviços públicos, ficam asseguradas 5% das vagas de trabalho para mulheres em situação de violência doméstica, desde que haja integrantes do programa com qualificação necessária para a ocupação das vagas.
