IRPF 2020: Como Retificar A Declaração?

Saiba como realizar a retificação caso tenha esquecido de informações ou preenchido erroneamente

Com a rotina do trabalho, estudo, filhos e da casa, e ainda mais agora viver nos tempos de pandemia, é comum alguns contribuintes entregarem a declaração com informações incompletas ou erros na ficha. Pensando nisso, a IOB, preparou algumas dicas para os contribuintes que precisam fazer a retificadora do Imposto de Renda.

Um ponto importante que vale destacar é que não é possível retificar a declaração entregue após o prazo final, que é 30 de junho, para alterar o modo de declarar. Ela também não será aceita quando o contribuinte estiver sob procedimento de ofício, ou seja, quando o contribuinte tiver direito à restituição na Declaração de Ajuste Anual do IRPF, mas, ao mesmo tempo, possui dívidas com a Receita Federal. O valor da multa para pessoa física que não declara o IR inicia no valor de R$165,74 e varia de acordo com o imposto devido.

Vale lembrar também que a Receita Federal não alterou a data da liberação dos lotes de restituição. Portanto, quem enviar antes do prazo limite, será restituído primeiro. Além disso, quem já declarou e está preocupado com a data da restituição, pode ficar tranquilo. No programa da receita, é possível visualizar se a declaração já foi processada e em qual lote sua restituição será paga.

Ajustando a declaração

Por conta da pandemia mundial do coronavírus, o prazo para envio da declaração que seria encerrado em abril, foi prorrogado para 30 de junho. Ou seja, o contribuinte tem até o fim desse período para declarar e caso precise, retificar a declaração.

A declaração retificadora tem a mesma natureza da original e a substitui integralmente. Ela deve contar com todas as informações declaradas anteriormente, mas com as alterações necessárias. Se o contribuinte descobrir que algo ficou faltando ou constatar algum erro no resultado do processamento da declaração, ele deverá efetuar uma retificação no prazo de até 5 anos.

A Receita Federal permite que os contribuintes ajustem as informações utilizando apenas o “Programa de declaração da Receita Federal”.  Para isso, é acessar o ícone “Declaração Retificadora” dentro da plataforma da declaração original, e, com o número do recibo da declaração anterior, alterar o que deve ser ajustado.

Como saber se preciso retificar?

Para saber se a retificação é necessária, basta acessar o resultado da sua declaração no “portal e-CAC” em “Meu Imposto de Renda (Extrato da DIRPF)”, usando certificado digital ou do código de acesso, e se após a entrega, constar “Com Pendências”, significa que foram encontradas informações que devem ser corrigidas.

Considerando situações distintas para cada contribuinte, a IOB separou alguns casos que podem constar no portal e os seus respectivos significados:

Situação Significado
Em processamento A declaração foi recebida, mas o processamento ainda não foi concluído.
Em Fila de Restituição Indica que o contribuinte tem direito a restituição após o processamento da declaração, mas que ainda não foi disponibilizada na rede bancária. Para recebimento da restituição, o contribuinte não poderá ter pendências de débitos no âmbito da RFB e ou da PGFN.
Processada A declaração foi recebida e o seu processamento foi concluído. Importante: a situação “processada” não significa que o resultado apurado tenha sido homologado, podendo ser revisto de ofício pela Administração Tributária (artigo 150, § 4º, do Código Tributário Nacional – CTN).
Com Pendências Durante o processamento da declaração foram encontradas pendências em relação a algumas informações. O contribuinte deve regularizá-las.
Em Análise Indica que a declaração foi recepcionada, encontra-se na base de dados da Secretaria Especial da Receita Federal do Brasil e aguarda:

a) a apresentação de documentos solicitados em intimação enviada ao contribuinte; ou

b) a conclusão da análise de documentos entregues pelo contribuinte por meio de agendamento, em atendimento à intimação a ele enviada, ou para apresentar Solicitação de Retificação de Lançamento (SRL).
Retificada Indica que a declaração anterior foi substituída integralmente por declaração retificadora apresentada pelo contribuinte.
Cancelada Indica que a declaração foi cancelada por interesse da administração tributária ou por solicitação do contribuinte, encerrando todos os seus efeitos legais.
Tratamento Manual A declaração está sendo analisada. Aguarde correspondência da Secretaria Especial da Receita Federal do Brasil.

“O contribuinte pode e deve fazer a retificadora, caso tenha preenchido algo errado. Mas precisa ficar atento e fazer isso antes do prazo final para não cair na malha fina”, afirma Valdir Amorim, consultor tributário da IOB.
